Which state has the lowest stamp duty in India?
Gujarat has one of the lowest stamp duty rates at 4.9%. Telangana (Hyderabad) has 4% stamp duty + 0.5% registration + 1.5% transfer duty = 6% total. Maharashtra gives women a 1% concession (5% vs 6%). Delhi gives women 2% off (4% vs 6%). Overall, Gujarat and Telangana are among the lowest stamp duty states for property purchase.
Is stamp duty included in home loan?
No — stamp duty and registration charges cannot be included in your home loan amount under normal circumstances. They must be paid from your own funds at the time of registration. Some banks offer separate personal loans or top-up loans for this purpose. These charges also don't qualify for 80C deduction directly (only principal repayment does), though first-time buyers can claim a one-time stamp duty deduction under Section 80C up to ₹1.5L.
When does property registration happen in India?
Property registration must happen within 4 months of the execution of the sale deed (extendable by 4 more months with penalty). Both buyer and seller (or their authorized representatives with PoA) must be present at the Sub-Registrar's office with: sale deed, ID proofs, PAN cards, passport photos, and payment challans for stamp duty and registration fees.
Can stamp duty be claimed as a tax deduction?
Yes — Section 80C allows a deduction for stamp duty and registration charges in the year of payment, subject to the overall ₹1.5L 80C limit. This is a one-time deduction available only in the year you pay the charges. It applies only to residential property (not commercial). This deduction is only available under the old tax regime (not the new regime).
