What properties are covered by AB 1482?

AB 1482 covers most rental housing in California built more than 15 years ago (on a rolling basis). Exempt properties include: single-family homes (unless owned by a corporation or REIT), condos (unless owned by a corporation), buildings built in the last 15 years, and units covered by stronger local rent control (LA, SF, Oakland, San Jose, etc.).

Can my landlord raise rent more than 10%?

Under AB 1482, no — the maximum is 5% + local CPI, capped at 10%, in any 12-month period. However, landlords can go above this for new tenants — the cap applies during tenancy, not between tenancies. Once a tenant moves out, landlords can set any new rent for the next tenant.

Does AB 1482 prevent evictions?

Yes — AB 1482 also requires "just cause" for eviction for covered tenancies. Allowable causes include: non-payment of rent, nuisance, illegal activity, owner move-in, withdrawal from rental market, or demolition. "No-fault" evictions (owner move-in, demolition) typically require relocation assistance of one month's rent.

Is my city covered by stronger rent control?

Many California cities have rent control ordinances stricter than AB 1482: Los Angeles (RSO — applies to buildings built before 1978, with smaller annual increases), San Francisco (very strict rent control plus just cause eviction), Oakland (CPI-based), San Jose (5% max or CPI, whichever is lower), Berkeley, Santa Monica. With 2024 LA CPI at ~3.4%, that's a maximum of 8.4% per year. On a $2,500/month unit, the max increase is $210/month. Landlords who exceed this can face penalties and must reverse unauthorized increases.

How the 15-year rolling exemption works

AB 1482 only protects units built more than 15 years before the current year. In 2024, this means buildings completed before 2009 are covered. A building completed in 2010 becomes covered in 2025. This rolling exemption was designed to avoid discouraging new housing construction — new buildings can command market rent to pencil out their construction costs.
