TDS on property sale by an NRI is deducted by the buyer under Section 195: 12.5% on Long Term Capital Gains (property held > 2 years) and 30% on Short Term Capital Gains (held ≤ 2 years), plus 4% cess. Note: TDS is on the capital gain, not the full sale price. However, in practice, buyers often deduct 20-30% of the total sale price unless the NRI obtains a lower TDS certificate (Form 13).
Can NRI avoid TDS by claiming DTAA benefit?
Yes. NRIs resident in countries with which India has a Double Taxation Avoidance Agreement (DTAA) can claim beneficial tax rates. For interest income: most DTAA rates are 10-15% (vs 20% default).
